HC panel asks Govt to notify plan to stop illegal mining  

Earlier direction for comprehensive action plan not implemented yet  

Shillong, Aug 14: The High Court-appointed Justice BP Katakey Committee has asked the state government to urgently launch a state-wide initiative to stop illegal mining and transport of coal, and frame a policy to shut and secure all abandoned rat-hole mines.

The Committee, in its 39th Interim Report submitted to the Meghalaya High Court, stated that its earlier direction for a comprehensive action plan has not been implemented yet.

Terming the delay concerning amid continuing illegal operations, the committee said immediate notification of the plan is critical for prevention, detection and enforcement.

According to the report, Mining and Geology Secretary told the Committee on June 29 that a draft State Action Plan has been prepared and is pending final approval.

“The comprehensive plan of action would be notified within 2 (two) weeks’ time,” the Secretary assured.

The Committee also raised alarm over unsecured mine openings that continue to pose risks to people and livestock.

While CMPDIL has submitted restoration DPRs for two pilot sites — Sutnga in East Jaintia Hills at Rs 92.78 lakh and Arenggtim in South Garo Hills at Rs 63.00 lakh — the report noted they lack interim safety measures.

“The aforesaid two project proposals… do not have any proposal for taking of adequate measures, including fencing of the mine openings, to prevent danger to human life and livestock till implementation,” it stated.

The proposals are awaiting clearance from the NGT-appointed Oversight Committee.

Stressing urgency, the Committee said the State must adopt a policy for closure and fencing of hazardous pits without delay.

It suggested the policy prioritise openings near villages and habitations and set clear timelines, given the large number of such sites across Meghalaya.

Deputy Commissioners have begun groundwork following the panel’s earlier recommendation.

DCs in East Jaintia and South Garo Hills have consulted Headmen and Nokmas on protecting and shutting pits close to settlements.

At the June 29 meeting, DCs of South West Khasi, West Khasi, West Jaintia and East Jaintia Hills committed to submit final proposals to the Mining Department within 10 days, while South Garo Hills sought 15 days.

Beyond enforcement and safety, the Committee recommended two structural measures.

It called for independent grievance redressal committees at State and district levels to handle complaints on illegal mining, with a transparent, technology-driven process, emergency powers, fixed timelines and whistleblower protection.

It also urged the government to frame an ex-gratia policy under Article 162 for families of those killed or injured in illegal mine accidents.

The policy should define eligibility, amount, verification and payment timelines, and allow recovery from mine owners, landowners and operators, while preserving the State’s right to pursue criminal action.

“A provision for appeal by the aggrieved person to the higher authority may also be made,” the report said.

The matter will be taken up again by the High Court.
