Shillong, May 20: BJP leader Bernard N Marak is under fire from the ruling National People’s Party (NPP) for his allegation linking Chief Minister Conrad K Sangma with the bail granted to former Phulbari MLA Esmatur Mominin, who was arrested in connection with the recent unrest in Garo Hills.
Another NPP leader and cabinet minister Marcuise N Marak on Wednesday slammed Marak for his alleged claim that the Chief Minister Conrad K Sangma shared a nexus with the minority leader from plain belt of Garo Hills.
The NPP state working president termed the allegation “totally unacceptable”, pointing out that the executive has no role in judicial decisions.
“So, bail was given by whom? Is it Chief Minister who has given the bail? No, it is not chief minister, the bail was given by the court,” Marcuise told reporters.
“So why don’t he (Bernard) ask the court there saying that chief minister is favouring. It is totally baseless; it is totally unacceptable statement. This statement was given just to mislead the people.”
He underscored the separation of powers enshrined in the Constitution.
“Practically in our democracy, executive, judiciary are totally separate entities. Constitutionally, judiciary don’t listen to the executive.”
Pointing out that the state government also contests cases in court, he said, “Even we have lots of cases pending in court, which we are fighting, but Bernard Marak is accusing chief minister favouring him because he got bail.”
“It is the judiciary which has decided to give the bail… based on what, we don’t know. Therefore, it is total baseless allegation,” Marcuise added.
